How Long Do You Have to File a Property Damage Claim in Texas?
Under Tex. Civ. Prac. & Rem. Code § 16.003(a), the statute of limitations for most property damage claims in Texas is two years. In other words, you must file a claim by the second anniversary of the date of the incident that caused damage to your personal property for the court to hear your claim. If you attempt to file a claim after this deadline passes, your case will almost certainly be dismissed and you will essentially lose your right to any legal remedy for your damaged property. For this reason, it is important to give yourself plenty of time and get an attorney involved as early as possible to avoid potentially costly pitfalls.
Fighting Back Against Unfair Claim Denials
If your insurance company says they will cover a certain type of property damage, they have a responsibility to honor your policy. Sometimes the insurance provider wants to save money, or simply doesn't understand the circumstances of the property loss, and so will deny your claim unfairly.
When your claim is denied, you are faced with covering the repairs yourself. Instead of giving up, ask our experienced Amarillo property loss attorneys to review your insurance policy with you, apply any necessary laws regarding insurance coverage, and help you confront your insurance provider to get the financial help you deserve.
In past cases our legal team represented, many of our clients’ property damage has forced them to temporarily leave their homes until the damage was fixed. When their insurance denied their claim, they couldn't mend the damage and had to continue living out of their home. We want to get you back home as soon as possible. For this reason, we work tirelessly to pursue your claim and hold your insurance provider accountable to the terms of your policy.
